Croatia Yacht Club terms and conditions, hereinafter referred to as CYC

1. Booking conditions

All bookings are binding as soon as they are confirmed. The client should immediately verify all information listed on the booking confirmation/invoice and in the case of any errors, the client must contact us immediately.  A booking of a sailing holiday should be considered the same as a group booking, where the  booker/agent is the main spokesman for contacts with CYC and underlying suppliers. He/she is responsible for all payments and forwarding of all information to the other participants in the group as well as making sure that the required proof of sailing competence is carried in original form to the destination.

2. Deposits and Final Payment

The down payment is 50% of the total sum and is to be paid no later than 7days after the booking is confirmed. The final payment is to be paid no later than 40 days before departure. If payment periods are coinciding, then both payments should be paid in one total sum. The client can choose to pay by credit card for online bookings on our website, or, by direct transfer with IBAN number to our bank account with the booking number as payment reference. When paying by credit card, CYC charges a fee of 1,9% of the paid amount. CYC has an agreement with the person/agent who made the booking and any changes or eventual cancellations must be made through the person/agent responsible for the booking. Any refunds are deposited back to the person/agent who made the booking.  If CYC does not receive the deposit or final payment as agreed, CYC has the right to consider the booking as cancelled.

3. Price guarantee

When the deposit has been paid, the price given on the booking confirmation is active. Should the exchange rate alter in any way before departure, there will not be any adjustment to the total cost. Any tax increases, customs, fuel surcharges or other service fees are not included in the price guarantee. All prices are calculated in Euro.

4. Cancellation

 In case of cancellation more than 40 days before departure CYC has the right to keep the down payment. In case of cancellation 39 days to 0 hours before departure CYC has the right to keep all the payment.  Cancellation protection is available for purchase and the cost for cancellation protection is added with the deposit fee which is not refunded in the case of an eventual cancellation. Cancellation is allowed if the passenger becomes seriously ill, or is affected by a worsening medical condition or an accident in which the passenger is not physically able to travel. The remaining passengers in the same reservation do not have the right to cancel since they are unaffected and still able to follow through with the trip and chartered boat. If the client or CYC finds another client for the cancelled booking the payment will be returned reduced with the eventual costs for CYC.

The passenger(s) should cancel the booking as soon as possible when a potential reason for cancelling has occured. The reason for cancelling should be proven with a medical certificate showing proof of acute illness, accident or death, and should be sent to CYC no later than 7 days after cancellation. The certifcate should include all necessary information for cancellation such as: 

a) the physician's specified advice not to partake in the arranged travel arrangements,

b) diagnosis,

c) the date for the initial treatment or examination,

d) the date for eventual treatment or examination, which is the underlying reason for the medical advice to refrain from travelling. The physician's office address, telephone number and name should be clearly stamped on the certificate.

5. Cancellation protection

A special cancellation protection can be purchased at the time of booking. You can choose to cover all passengers or only certain passengers. The cancellation protection covers every aspect of the trip that you have booked through CYC. The cancellation protection fee is not refundable. 

6. Personal Insurance

The insurance for the boat is only for damages to the boat including equipment and coverage for third persons, but not for any personal injuries to passengers or their belongings. Check your home insurance carefully or acquire a separate travel insurance which will cover most problems and provide active protection.

7. Competence requirements for sailing in Croatia

The competence requirements for chartering a boat in Croatia are so that at least one person on board must be able to prove his/her navigational competence for the chartered boat size, with the miminum being a driving and VHF certificate. These do not have to be from the same person. The documents should be submitted at check-in in their original form and in english.  CYC assumes no economical responsibility for invalid certification or lack of it at the time of check-in.  CYC follows navigation regulations regarding nautical competence. Please check with your nautical authorites if you are unsure if your certificate or license is valid. Skippers can be rented if you are lacking the adequate nautical competence.

 

8. Checking-in and out

The boat is available from 5.00 pm on arrival day, until 9.00 am on the day of departure. The boat should be back at the base by 6.00 pm at the latest on the day before check-out since inspection of the boat (including a diving check) must take place in daylight. It takes up to 2 hours and is counted in the rental period.

To promote good service we try to begin the check-in process earlier, when possible. Staff from CYC or another agent at the marina will go through the equipment and operations together with the skipper. The documents will be signed and the responsibility for the boat is then handed over to the skipper.

Any eventual damages will be inspected, estimated and addressed at check-out. CYC is not responsible for any inconveniences caused by loss of electricity at the base, or similiar problems. It is worth noting that the extra beds do not have the same quality as the ordinary ones. In CYC's marketing and specifications of the boats, we provide the number of extra beds after the plus (+) symbol. For example, 8+2+2, which means there are 8 regular beds + 4 extra beds. 

7.Deposit

The boat is fully insured, but the deductible must be deposited by the crew at the check in, by cash or credit card. The deposit varies by boat size (see your booking confirmation) from 500 Euro. In case of damage CYC will charge the equivalent amount of the deposit, and if the damage costs are higher then the deposit, CYC has the right to keep the total deposit. The deposit for a regatta is doubled.

8. Cancellation of special events and arrangements

If CYC has reasonable grounds to believe that there are not enough participants for a special arrangement as planned, CYC has the right to cancel the arrangement. In rgw case of cancellation the client must be informed as soon as possible after the decision is made but no later than 14 days before the planned departure.

9.. Contact information

The client is responsible to inform CYC about their perosnal contact details so that he/she can receive all the important messages, such as eventual changes, via e-mail.

10. Complaints

When a problem occurs, the client must immediately contact the base through the service phone number (emergency number) so that any corrections can take place as soon as possible. If the problem can not be solved, the client has the right to claim compensation which must be handed in in the form of a written notification no later than check-out.

11. CYC Satisfied Customer Warranty

Our goal is that everyone leaves the CYC base fully satisfied. We can not guarantee that the boat will always work perfectly, since errors can occur due to accidents, improper handling and weather, etc.. If the problem can not be solved, we will replace the boat with an equal substitute or better. We will examine the cause of the problem is and try to find a reasonable solution by agreement.
